1. INTRODUCTION

These Terms and Conditions ("Terms") govern your access to and use of the website www.bettereats.in ("Website") and the ordering of products offered by Better Eats within Gurgaon, Haryana, India.

By accessing the Website, placing an order, or using any service on the Website, you agree to be bound by these Terms and all applicable laws and regulations in India.

Better Eats is a food business operating from M3M Merlin, Sector 67, Gurgaon, Haryana, 122102, India ("we", "us", "our").

3. ELIGIBILITY AND USER OBLIGATIONS

You must be at least 18 years of age and capable of entering into a legally binding contract under the Indian Contract Act, 1872 to place an order on the Website.

You agree to provide accurate, current and complete information during registration, checkout and any subsequent communications, and to update such information as required.


4. SERVICE TERRITORY AND NATURE OF PRODUCTS

Better Eats currently accepts orders only for delivery within specified serviceable areas of Gurgaon, Haryana, India, as displayed on the Website or communicated at checkout.

Products offered are freshly baked desserts and allied food items; actual appearance, size, colour and decoration may vary slightly from reference images due to the artisanal and small-batch nature of production.


5. PRODUCT INFORMATION, ALLERGENS AND HEALTH CLAIMS

We endeavour to display accurate product descriptions, ingredients, allergen information and nutritional data where applicable, in line with FSSAI labelling and e‑commerce advisories.

Despite reasonable care, minor variations or omissions may occur; customers with allergies or specific medical conditions must contact us before ordering and are responsible for assessing suitability of products for their own consumption.


6. ORDERING PROCESS AND ACCEPTANCE

Placing products in the cart or initiating payment does not constitute order acceptance; your order is an offer to purchase, which we may accept or reject at our sole discretion.

Order acceptance occurs only when you receive a final order confirmation via email/SMS/Website screen, after successful payment and validation of delivery availability for your address in Gurgaon.


7. PRICING, TAXES AND PAYMENT

All prices are displayed in Indian Rupees (INR) and are inclusive of applicable taxes, unless expressly stated otherwise.

We reserve the right to revise prices, discounts, and delivery charges at any time, provided that the price at the time of your confirmed order shall apply to that specific order.

Payment must be made in full at the time of placing the order using the payment methods listed at checkout (e.g., UPI, cards, net banking, wallets, or other gateways).

If your payment fails, is reversed, or is suspected as fraudulent, we may cancel the order or require additional verification before processing.


8. DELIVERY, RISK AND DELAYS

Delivery will be made only to eligible pin codes within our serviceable areas of Gurgaon, as shown on the Website or confirmed during checkout.

Indicative delivery dates and time-slots are estimates; while reasonable efforts are made to meet these, delays can occur due to traffic, weather, operational constraints or events beyond our control.

Risk of loss and damage to products passes to you at the time of delivery to the address provided by you or to any person reasonably claiming to be authorised to accept delivery on your behalf.

You are responsible for promptly receiving the order and storing the products as per the instructions mentioned on the Website or packaging (e.g., refrigeration, consumption within a specified time).


9. FRESHNESS, STORAGE AND SHELF LIFE

Our desserts are freshly prepared and may have a limited shelf life; products are typically best consumed on the day of delivery or within the period specified on the product page/packaging.

We are not liable for any deterioration in quality, taste or safety if storage instructions are not followed, the delivery is delayed due to your unavailability, or the products are consumed after the recommended period.


10. CANCELLATIONS, MODIFICATIONS AND REFUNDS

Once an order is placed and confirmed, it may not be cancellable or modifiable, especially for same‑day or made‑to‑order items; any exception will be at our sole discretion and may involve cancellation fees.

Requests must be raised within the timelines and via the channels specified on the Website (email/phone/WhatsApp), and are subject to confirmation.

We may cancel an order due to non‑availability of products, operational issues, incorrect pricing, payment issues, or other legitimate reasons, in which case we will initiate a refund of the amount received for that order to the original payment method, subject to gateway timelines.


11. RETURNS, REPLACEMENT AND COMPLAINTS

Due to the perishable nature of our products, returns are generally not accepted once the order has been delivered.

However, if you believe there is a quality, safety, or delivery issue (such as wrong item, significant damage, or suspected contamination), you must contact us within the same day of delivery or within the timeframe mentioned in the Refund Policy, provide clear details, order ID, photographs, and any other information requested to assess your complaint.

Where a genuine issue is established, remedies may include replacement, partial refund, full refund, or such other solution as we deem appropriate, subject to applicable laws and our internal policies.


12. USE OF WEBSITE AND INTELLECTUAL PROPERTY

All content on the Website, including text, logos, images, graphics, recipes, and other materials, is owned or licensed by Better Eats and is protected under applicable copyright, trademark and other intellectual property laws in India.

You may not copy, reproduce, distribute, modify, create derivative works, or exploit any part of the Website or its content for commercial purposes without our prior written consent.

You agree not to use the Website for any unlawful or fraudulent purpose, attempt to gain unauthorised access to any part of the Website or related systems, or introduce viruses, malware or other harmful code.


13. USER ACCOUNTS AND SECURITY

Where the Website allows account creation, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

We may suspend or terminate your access if we suspect misuse, fraud, breach of these Terms or any applicable law.


14. DATA PROTECTION AND PRIVACY

Your use of the Website and any data shared with us (including personal and payment information) is governed by our Privacy Policy, which is incorporated into these Terms by reference.

We take reasonable technical and organisational measures to protect your information, but cannot guarantee absolute security of data transmitted over the internet.


15. COMPLIANCE WITH FOOD SAFETY AND FSSAI REQUIREMENTS

Better Eats operates subject to applicable food safety laws in India, including the Food Safety and Standards Act, 2006 and allied regulations, as may be applicable to our operations.

We are committed to accurate and non‑misleading representation of our products online, including with respect to ingredients, allergens, nutritional claims and shelf life, in line with FSSAI guidance for e‑commerce food businesses.


16. DISCLAIMER OF WARRANTIES

The Website and its services are provided on an "as is" and "as available" basis, without any warranties of any kind, whether express or implied, except to the extent required under Indian law.

To the fullest extent permitted by law, we disclaim all implied warranties, including but not limited to fitness for a particular purpose, merchantability, and non‑infringement, in relation to the Website and its content.


17. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Better Eats, its owners, employees, and agents shall not be liable for any indirect, incidental, consequential, punitive or special damages arising out of or in connection with your use of the Website, products or services.

Our total aggregate liability for any direct damages in relation to a specific order shall be limited to the amount actually paid by you for that order.


18. INDEMNITY

You agree to indemnify, defend and hold harmless Better Eats and its officers, employees and agents from and against any claims, demands, liabilities, losses, damages and expenses (including reasonable legal fees) arising out of or related to your breach of these Terms, misuse of the Website, violation of applicable laws, or infringement of any third‑party rights.


19. FORCE MAJEURE

We shall not be liable for any failure to perform or for any delay in performance of our obligations where such failure or delay is due to events beyond our reasonable control, including but not limited to acts of God, natural disasters, epidemics, strikes, breakdown of systems, governmental actions, or disruptions in transport and logistics.


20. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and interpreted in accordance with the laws of India.

Subject to applicable consumer laws, the courts at Gurgaon, Haryana shall have exclusive jurisdiction over all disputes arising out of or in connection with these Terms or any use of the Website or purchase of products through it.


21. CONSUMER RIGHTS AND GRIEVANCE REDRESSAL

Nothing in these Terms is intended to limit your rights as a consumer under the Consumer Protection Act, 2019 and the Consumer Protection (E‑Commerce) Rules, 2020, to the extent applicable.

You may raise grievances or complaints by writing to connect@bettereats.in with your order details and contact information; a grievance officer or designated representative will be assigned and contact details may be published in the Privacy Policy or a dedicated Grievance section on the Website.


22. AMENDMENTS TO THESE TERMS

We may update or modify these Terms at any time to reflect changes in our business, legal or regulatory requirements, or Website features.

The revised Terms will be effective from the date they are posted on the Website, and continued use of the Website or placing orders after such posting will constitute your acceptance of the updated Terms.


23. SEVERABILITY AND ENTIRE AGREEMENT

If any provision of these Terms is held to be invalid, illegal or unenforceable, the remaining provisions shall continue in full force and effect.

These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy and any specific product‑level terms, constitute the entire agreement between you and Better Eats regarding the use of the Website and purchase of products through it.
